OFFICIAL RULES & REGULATIONS

PROMOTION OVERVIEW

From January 30, 2017 through April 21, 2017, or the day on which the last accessory is taken (“Program Period”), buy any two “Qualifying Products” (defined below), send “Qualifying Receipt” (defined below) and register as described in “How to Register” (explained below) in order to receive one of three “Car Accessories” (defined below). “Car Accessories” available while supplies last.

QUALIFYING PRODUCTS

In order to be eligible to receive 1 of 3 Car Accessories, consumer must purchase two (2) “Qualifying Products”, which include all formats: OTC (over the counter; single units),
Bottle and MTP (Multi-Pack) from the following Brands: Excel and Juicy Fruit.

QUALIFYING RECEIPT

To be considered a “Qualifying Receipt”, consumer’s submission must meet all of the following criteria: be dated within the “Program Period”, cannot have been previously submitted and accepted, must be submitted as a JPG, GIF or PNG of 10MB or less, must be clear and legible, must have been issued by a Canadian retailer, must feature a minimum of two (2) “Qualifying Products”. Each receipt is only valid for one accessory, regardless of how many products are purchased beyond the required two (2) products.

CAR ACCESSORIES

Car Accessory prizes include an Excel Branded Spearmint Scented Air Freshener, Excel Branded White Car Charger, and Excel Car Clip for a car vent. Promotion entrants are given car accessory at random. The consumer is not able to choose which accessory they would like to receive. All accessories are available to consumers while supplies last. Car Accessories cannot be exchanged for their monetary value.

HOW TO REGISTER

To register, go to either www.excelgum.ca or www.excelgumgiveaway.ca (“the Website”) to complete and submit the registration form. Consumers will be required to enter their first and last name, email address, date of birth, complete mailing address (street name and number, city, province/territory and postal code), telephone number and upload a valid receipt with proof of purchase of two (2) participating Excel products. Receipt must have a star or check beside two (2) ”Qualifying Products”, and receipt photo must be clear and legible. To participate by mail, provide a 3”x 5” postcard with contact information and original “Qualifying Receipt” (complete details to submit by mail below).

  1. If you agree to be legally bound by the Official Rules, signify your acceptance and understanding of the Official Rules by checking the “Agree” checkbox where indicated. If you do not agree to be legally bound by the Rules, then you will not be permitted to participate in this Program. Once you have successfully completed the Registration with all of the required information and have agreed to the Rules and Regulations (the “Rules”), follow the on-screen instructions to submit your completed Registration.
  2. There is a limit of one (1) Registration per person. Consumers are allowed to enter the promotion numerous times, each with a unique qualifying receipt, as long as consumers do not register for the promotion under several different identities. For greater certainty and the avoidance of any doubt, you can only use one (1) email address to enter the Program. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Registration; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Program; then he/she may be disqualified from the Program in the sole and absolute discretion of the Sponsor. Your Registration may be rejected if (in the sole and absolute discretion of the Sponsor) the Registration form is not fully completed with all required information and submitted and received in accordance with these Rules during the Program Period. The Program Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Registrations (all of which are void).
  3. Entrants cannot use the same receipt more than once throughout the promotion period. Each unique receipt (with a minimum of two [2] Qualifying Products) qualifies consumer to receive 1 of 3 Car Accessories, while supplies last.
    1. The Excel Car Offer (the “Program”) is intended for viewing and participation in Canada only and shall be construed and interpreted according to the applicable laws of Canada. Please do not proceed if you are not a natural person who (at the time of Entry): (i) is a resident of and physically located in Canada; and (ii) has reached the legal age of majority in your province or territory of residence (see “Eligibility” below).
    2. Internet access and a valid e-mail address are required to participate in the Program. Many public libraries, retail businesses and others offer free computer and Internet access and a number of Internet service providers and other companies offer free email addresses.
    3. Standard data rates may apply to entrants who choose to participate in the Program using their mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation. Wrigley Canada, Licensee of the Wm. Wrigley Jr. Company or its affiliates are not responsible for data overages.
RECEIPT SUBMISSION

To successfully complete submission, entrants will also be required to take a clear and legible photograph of their receipt to indicate proof of purchase of any two (2) Qualifying Products. Receipt photograph must not exceed 10MB and must be submitted in JPG, GIF or PNG format. Receipt must be obtained from a Canadian retailer and must be itemized to indicate the two (2) Qualifying Products. Receipt dates must correspond with the promotional period of January 30, 2017-April 21, 2017.

Before submitting the receipt, entrants must highlight the two (2) “Qualifying Products” on the receipt with a star or check. Participating products include all formats (OTC (over the counter; single units), Bottle and MTP (Multi-Pack) from the following Brands: Excel and Juicy Fruit.

Submitting Qualifying Receipt Via Mail: An Entrant who chooses to submit the Qualifying Receipt via mail, will need to provide a 3”x5” postcard with their First and Last Name; Complete Mailing Address, including: City, Province/Territory, Postal Code; Date of Birth; E-mail Address, with the original Qualifying Receipt of the Qualifying Receipt, to: Hunter Straker, 100 Liberty Street, Toronto, Ontario, M6K 3L7. The 3”x5” postcard must include all the required registered information; missing information will void the receipt entry. Limit one (1) Receipt per Mail-In Envelope. The Mail-In Envelope must be received by April 21, 2017 to allow for sufficient processing time.
MAXIMUM NUMBER OF ENTRIES
  1. The maximum number of Entries that an eligible entrant can earn in relation to this Program is as many as the number of unique Qualifying Receipt, subject to how long supplies last. It is up to the consumer’s discretion on how often they want to purchase participating products throughout the promotion.
VERIFICATION
  1. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Program; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Registration, Entry and/or other information entered (or purportedly entered) for the purposes of this Program; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Program in accordance with the letter and/or spirit of these Rules.
  2. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Program will be the Program server machine(s).
REDEEM CAR ACCESSORY

Redeem Car Accessory: There are a total of eight thousand (8,000) Car Accessories (each, a “Car Accessory” and collectively, the “Car Accessories”) available to be redeemed throughout the duration of the Program, while supplies last. Each Accessory has an average retail value of $3.33.

  1. Each Car Accessory must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). Consumer cannot choose which accessory they receive. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Accessory with another item of equal or greater retail value, if quantity of a given Accessory runs out, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award.
  2. Eligible Car Accessories to be redeemed:
    • Two thousand (2,000) units of Excel Branded Spearmint Scented Air Fresheners (ARV $2)
    • Three thousand (3,000) units of Excel Branded White Car Chargers (ARV $4)
    • Three thousand (3,000) units of Excel Car Clips for your vent + one (1) Excel Bottle (ARV $4)
  3. The choice of Car Accessories you are eligible to receive will be made randomly by the Sponsor in its sole and absolute discretion. There is no way of knowing in advance which Accessory you will receive if selected as a recipient.
  4. Car Accessories are not meant for human consumption. Use Car Accessories at your own sole risk and discretion. Sponsor is not responsible for any damage to your vehicle. Use all items at your own discretion.
ELIGIBLE RECIPIENT SELECTION MECHANISMS
  1. Accessories: Eligible entrants will find out if they will receive an Accessory in the following way:
    1. Upon Entry completion the entrant will find out if they will receive 1 of 3 Accessories via pop-up messaging and email confirmation.
    2. If all Car Accessories have been awarded, promotion website will indicate this, and will no longer be open for Registration and receipt submission.
  2. Those entrants that have qualified to receive 1 of 3 Accessories can expect to receive their Accessory via Canada Post 4-5 weeks after receiving their redemption confirmation pop-up and email. The Accessory will be shipped to the address indicated on the entrant’s Form.
ELIGIBLE RECIPIENT CONFIRMATION PROCESS:
  1. ENTRANT’S RECEIPT DEEMED VALID AND CONFIRMED THAT ENTRANT WILL BE SENT A CAR ACCESSORY: For a receipt to be deemed “valid” the photograph of the receipt must not exceed 10MB, must be submitted in JPG, GIF or PNG format, the receipt must not have been previously submitted and validated, the receipt must be legible and contain at least two (2) participating products, and the receipt must be dated between January 30, 2017 and April 21, 2017. By participating in this Program and accepting a Car Accessory, each eligible recipient hereby: (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable Accessory (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Program, his/her participation therein and/or the awarding and use/misuse of the applicable Car Accessory or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Program and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the  Internet. If an eligible recipient: (a) cannot accept (or is unwilling to accept) the applicable Car Accessory (as awarded) for any reason; and/or (b) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, must forfeit all rights to receive the applicable Accessory.
GENERAL CONDITIONS
  1. All Registrations and Entries become the property of the Sponsor. This Program is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Program are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Registrations, Entries and/or entrants. By participating in this Program, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
    1. Unless otherwise directed by the Sponsor, no correspondence will be entered into except with the selected eligible recipients. The Released Parties are not responsible for typographical or other errors in the offer or administration of this Program, including but not limited to errors in advertising materials, these Rules, the selection and announcement of the Accessories and/or Accessory eligible recipients and/or the distribution of the Accessories.
    2. Further, the Released Parties will not be liable for: (i) any failure of the Website during the Program; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry, Registration and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Program; and/or (v) any combination of the above.
    3. In the event of a dispute regarding who submitted a Registration/Entry, the Sponsor reserves the right, in its sole and absolute discretion, to deem the Registration/Entry to have been submitted by the authorized account holder of the email address submitted at the time of Registration. “Authorized account holder” is defined as the person who is assigned an email address by an Internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Registration/Entry in question.
    4. Releases: Entrants and Promotion Recipients release and indemnify the Promotion Sponsor, as well as its affiliates, advertising and promotion agencies, and their partners, employees, agents, and representatives from all liability for any damage sustained as a result of participation in the Promotion or the acceptance and/or use (or non-acceptance or non-use) of the Prizes.
    5. The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Program (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Program as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to damage any website or to undermine the legitimate operation of this Program in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Program, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
    6. For Quebec residents: Any litigation respecting the conduct or organization of a publicity Program may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of an Accessory may be submitted to the board only for the purpose of helping the parties reach a settlement.
    7. The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Program mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Program as contemplated in these Rules, or for any other reason.
    8. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Program-related materials, including, but not limited to: the Form, Website, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.
    9. This Program is exclusively governed by and construed in accordance with the domestic laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Except as noted in Rule 11f, any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
    10. By entering this Program, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Registration/Entry only for the purpose of administering the Program and in accordance with Sponsor’s privacy policy (available at: http://www.wrigley.com/global/privacy-statement.aspx).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.
